This Privacy Notice for Asphalt Paving Mastery LLC (doing business as Asphalt Paving Mastery) ("we," "us," or "our") describes how and why we might access, collect, store, use, and/or share ("process") personal information when you use our services ("Services"), including when you:

  • Subscribe to Asphalt Paving Mastery, our device-based subscription training platform for hot-mix asphalt operations covering safety, materials, equipment, field execution, quality verification, and emerging technologies including three-dimensional machine control;

  • Engage with us in other related ways, including any marketing, sales, or events.

Questions or concerns? Reading this Privacy Notice will help you understand your privacy rights and choices. We are responsible for making decisions about how your personal information is processed. 1. WHAT INFORMATION DO WE COLLECT?

Important context for our subscription model. Our Services are delivered as a device-based subscription. The Subscriber holds the account, pays for the subscription, and authorizes a specified number of Devices to access course content. Workers who view course content on a Subscriber's authorized Devices do not have individual accounts with us, do not register with us, and are not enrolled as individual students of Asphalt Paving Mastery LLC. We therefore do not collect personal information about individual workers viewing content on shared Subscriber Devices on the Independent, Regional, or National subscription tiers.

Subscriber Personal Information You Disclose to Us

In Short: We collect personal information from the Subscriber that you provide when you create an account, complete a purchase, or contact us.

We collect personal information that you voluntarily provide to us when you subscribe to the Services, request information about us or our Services, participate in activities on the Services, or otherwise contact us. The personal information we collect from the Subscriber depends on the context of your interactions with us and may include:

  • Name of the Subscriber (individual or organizational name);

  • Name of the individual responsible for the Subscriber's account (the account holder);

  • Business email address;

  • Business phone number;

  • Business mailing address;

  • Job title of the account holder;

  • Company affiliation and business contact details;

  • Username and password (used by the Subscriber's account holder to access the platform);

  • Contact preferences and authentication data;

  • Billing address.

Payment Data

When you purchase a subscription, payment data necessary to process the transaction is collected and handled by Stripe, our payment processor. Payment instrument numbers (such as credit card numbers) and security codes are not stored on our servers. Stripe's privacy notice is available at https://stripe.com/privacy.

For qualifying Enterprise subscribers paying by ACH bank transfer or check, additional banking or organizational information may be collected as necessary to process the payment.

Information Automatically Collected

In Short: Some technical information is collected automatically when Devices authorized under your subscription access the Services.

When Devices authorized under a Subscriber's account access the Services, certain technical information is automatically collected by us and by our subscription platform provider (Uscreen). This information is collected at the Device and account level, not as part of an individual worker profile. It may include:

  • Log and Usage Data. Service-related, diagnostic, usage, and performance information automatically collected when authorized Devices access the Services. This includes IP address, browser type, device characteristics, operating system, language preferences, referring URLs, timestamps of access, course content streamed, viewing duration, and similar technical information associated with the Subscriber's account.

  • Device Data. Information about the hardware unit accessing the Services, including device identifiers, browser version, hardware model, operating system version, and similar technical specifications.

  • Location Data. General location data derived from the IP address of authorized Devices. We do not collect precise GPS coordinates.

This automatically collected information is used to maintain the security and operation of our Services, enforce subscription device limits, prevent piracy or unauthorized access, support our internal analytics, and respond to technical issues. It is associated with the Subscriber's account, not with individual workers who may be viewing content on a Subscriber's authorized Device.

Aggregate Account-Level Usage Data

We and our subscription platform provider may collect aggregate, account-level usage metrics describing how the Subscriber's authorized Devices are using the Services — such as which modules are most viewed, how many viewing sessions occur per month, and at what times of day Devices are most active. This data is associated with the Subscriber's account and is not individualized to specific workers viewing content on shared Devices.

Information Collected from Other Sources

In Short: We may collect business contact information from public sources and industry events for sales outreach.

We may obtain business contact information about potential Subscribers from sources other than the individual directly. These sources include:

  • Public Databases and Business Contact Sources. Business contact information (such as names, job titles, business email addresses, phone numbers, and company affiliations) obtained from public databases, professional networking platforms (such as LinkedIn), business data providers, industry directories, and similar sources for purposes of business-to-business sales outreach and marketing.

  • Referrals. Existing Subscribers may refer potential Subscribers to us or provide their contact information for purposes of introducing our Services.

  • Industry Events and Trade Shows. When you interact with us at industry events, trade shows, or conferences, we may receive your business contact information from event organizers or directly through badge scanning systems.


2. WHAT WE DO NOT COLLECT

In Short: Our device-based subscription model is designed to limit data collection. There are categories of personal information that other training providers collect but we do not.

To make our data practices transparent, we want to be explicit about what our subscription model does not require us to collect:

  • We do not collect individual student information on standard tiers. The Independent, Regional, and National subscription tiers do not involve individual student enrollment. We do not collect names, contact information, employment information, or any other personal information about individual workers who view course content on a Subscriber's authorized Devices.

  • We do not maintain individual training records, progress data, or completion records on standard tiers.Because we do not enroll individual workers, we do not maintain per-worker training records, individual progress dashboards, individual assessment scores, or individual completion certificates on the Independent, Regional, or National tiers.

  • We do not collect sensitive personal information. We do not collect racial or ethnic origin, religious or philosophical beliefs, trade union membership, genetic data, biometric data, health data, sex life or sexual orientation, or other categories defined as sensitive under applicable privacy laws.

  • We do not collect biometric identifiers. We do not collect fingerprints, voiceprints, facial geometry, or other biometric identifiers.

  • We do not collect children's data. Our Services are exclusively for adult professional users 18 years of age and older.

  • We do not engage in profiling or automated decision-making that produces legal or similarly significant effects about individuals.

  • We do not sell personal information. We have not sold personal information in the preceding twelve months and do not currently sell personal information as defined under applicable U.S. state privacy laws.

  • We do not share personal information for cross-context behavioral advertising. We do not engage in behavioral or targeted advertising.

Enterprise Subscribers: Custom Data Provisions

Enterprise Subscribers may, by separate Enterprise Subscription Agreement, request and receive organizational usage reports, viewing summaries, or other documentation features that go beyond what is provided on standard tiers. Any expanded data collection or reporting provisions for an Enterprise Subscriber will be specified in the Enterprise Subscription Agreement and conducted in accordance with applicable privacy laws and this Privacy Notice.


3. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide and administer our Services, communicate with you, ensure security and prevent fraud, and comply with applicable law.

We process Subscriber personal information for the following purposes:

  • To facilitate account creation and authentication. We process Subscriber information to set up and maintain the Subscriber's account, including account-holder login credentials.

  • To provide and deliver the Services. We process Subscriber information to deliver subscription access, authenticate authorized Devices, and enforce subscription terms including Device limits and Premium Module access.

  • To process payments. We process Subscriber billing information to fulfill subscription orders, manage renewals, and address payment issues. Payment instrument data is handled by our payment processor.

  • To respond to inquiries and provide customer support. We process Subscriber information to respond to inquiries and resolve issues related to the Services.

  • To send administrative communications. We process Subscriber information to send administrative messages about your account, our Services, changes to our terms and policies, and similar non-marketing communications.

  • To send marketing and promotional communications. We process business contact information for marketing purposes in accordance with applicable law and your marketing preferences. You can opt out of marketing communications at any time.

  • To request feedback. We may process Subscriber information to request feedback about the Services.

  • To post testimonials. We may post testimonials on our Services with the express permission of the Subscriber providing them.

  • To protect our Services. We process technical information to keep our Services secure, prevent piracy and unauthorized content reproduction, monitor for fraud, and enforce our Terms of Service.

  • To improve our Services. We process aggregate account-level usage data to understand how Subscribers are using the Services, identify trends, and improve content and platform functionality.

  • To comply with legal obligations. We process information as needed to comply with applicable laws and respond to lawful legal requests.


4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We share information with service providers who help us operate our business. We do not sell personal information.

We may share Subscriber personal information in the following situations:

Service Providers

We share personal information with third-party service providers who perform services for us and require access to your information to do that work. These service providers are contractually restricted from using your information for any purpose other than providing services to us. Our current service providers include:

  • Uscreen — our subscription platform provider, responsible for hosting the course content, managing subscription access, tracking Device authentication and usage, and processing technical data necessary to deliver the Services. Uscreen's privacy practices are described in their privacy policy.

  • Stripe — payment processing for credit, debit, and other electronic payments.

  • Squarespace — our website hosting and content management platform.

  • Microsoft 365 — business communications, email, and document management.

  • Google (Analytics, Workspace, Fonts) — analytics, productivity tools, and website infrastructure.

  • Email service provider — for transactional and marketing email delivery.

This list may be updated as our service provider relationships evolve. The current list of service providers is available upon request.

Enterprise Subscriber Administrators

For Enterprise Subscribers, the Enterprise Subscription Agreement may designate one or more individuals as administrators with access to organizational account data, including any organizational usage reports the Enterprise Subscriber has elected to receive. The scope of administrator access is set forth in the Enterprise Subscription Agreement.

Legal Requirements

We may disclose personal information where required by law, including in response to subpoenas, court orders, regulatory requests, or other valid legal processes. We may also disclose information when necessary to:

  • Comply with applicable laws and regulations;

  • Respond to lawful requests from public authorities;

  • Protect our legal rights, property, or safety;

  • Protect the rights, property, or safety of our users or others;

  • Investigate, prevent, or take action regarding suspected illegal activities, fraud, intellectual property violations, or violations of our Terms of Service.

Business Transfers

We may share or transfer information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business. In such cases, we will provide notice and require the receiving party to honor the commitments in this Privacy Notice.

With Your Consent

We may share information for purposes outside the scope of this Privacy Notice only with the Subscriber's explicit consent.

We Do Not Sell Personal Information

We do not sell, rent, or trade Subscriber personal information for monetary or other valuable consideration. We do not share personal information for cross-context behavioral advertising purposes.


5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We use cookies and similar technologies for security, functionality, and analytics. We do not use them for targeted advertising.

We use cookies and similar tracking technologies (such as web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.

We use cookies and tracking technologies for the following purposes:

  • Strictly necessary cookies — for login authentication, security, payment processing, and core platform functionality;

  • Analytics cookies — to understand how Subscribers interact with our Services so we can improve them (such as through Google Analytics);

  • Functional cookies — to remember preferences and provide enhanced features;

  • Email engagement tracking — to measure email open rates and link clicks in our marketing and transactional emails.

We do not currently use cookies or tracking technologies for targeted advertising, behavioral advertising, or remarketing purposes. If our practices change in the future, we will update this Privacy Notice and obtain appropriate consent where required.

To the extent any online tracking technologies we use are deemed to be a "sale" or "sharing" under applicable US state laws, you can opt out as described in the section "Do United States Residents Have Specific Privacy Rights?"

6. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep Subscriber information for as long as your subscription is active and for a reasonable period thereafter, subject to legal retention requirements.

We retain Subscriber personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

Our general retention practices include:

  • Subscriber account information is generally retained for up to thirty-six (36) months past the termination of the subscription, unless longer retention is required by law or for legitimate business purposes such as fraud prevention, dispute resolution, or enforcement of our Terms of Service.

  • Financial and transaction records are retained for at least seven (7) years as required by applicable tax law and IRS recordkeeping requirements.

  • Marketing communications data is retained while you remain an active Subscriber and for a reasonable period necessary to maintain suppression lists for individuals who have opted out of marketing communications.

  • Aggregate usage data may be retained indefinitely in anonymized or de-identified form for the purposes of service improvement and analytics.

  • Enterprise Subscriber documentation retention may be governed by the applicable Enterprise Subscription Agreement.

When we have no ongoing legitimate business need to process Subscriber personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because the information has been stored in backup archives), then we will securely store the information and isolate it from any further processing until deletion is possible.


7. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We use appropriate organizational and technical safeguards to protect personal information.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure information, no electronic transmission over the Internet or information storage technology can be guaranteed to be one hundred percent secure. We cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify information. Although we will do our best to protect personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.


8. DO WE COLLECT INFORMATION FROM MINORS?

In Short: Our Services are exclusively for adult professional users. We do not knowingly collect information from individuals under 18 years of age.

Our Services are designed exclusively for adult professional users in the asphalt paving industry. We do not knowingly collect, solicit data from, or market directly to individuals under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 years of age.

If we learn that personal information from individuals less than 18 years of age has been collected, we will take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have improperly collected from individuals under age 18, please contact us at Support@AsphaltPavingMastery.com.


9. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: You may review, change, or terminate your account at any time. Depending on your location, you may have additional rights under applicable privacy law.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on applicable law, you have the right to withdraw your consent at any time by contacting us using the contact details below.

Withdrawal of consent will not affect the lawfulness of processing before its withdrawal, nor will it affect processing conducted in reliance on lawful processing grounds other than consent.

Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications at any time by clicking the unsubscribe link in any marketing email we send, or by contacting us at Support@AsphaltPavingMastery.com. You will then be removed from marketing lists. However, we may still communicate with you for non-marketing purposes such as service-related messages, responses to support requests, billing notices, and similar account administration.

Account Information

If you would at any time like to review or change the information in your Subscriber account or terminate your subscription, you can:

  • Log in to your account settings and update your account information;

  • Contact us using the contact information provided below.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information to prevent fraud, troubleshoot problems, assist with investigations, enforce our legal terms, and/or comply with applicable legal requirements.

Cookies and similar technologies: Most web browsers are set to accept cookies by default. You can usually choose to set your browser to remove cookies or reject cookies. If you choose to remove or reject cookies, this could affect certain features of our Services.

10. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is no industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

Global Privacy Control: We recognize and honor Global Privacy Control (GPC) signals. If you use a browser or extension that supports GPC, we will treat this as a valid request to opt out of the sale or sharing of your personal information for targeted advertising purposes under applicable state privacy laws, including the California Consumer Privacy Act (CCPA). When we detect a GPC signal from your browser, we will automatically apply your opt-out preference without requiring you to take any additional action. Sale, Sharing, and Targeted Advertising

We have not sold or shared personal information with third parties for cross-context behavioral advertising purposes or other valuable consideration in the preceding twelve (12) months. We do not currently sell or share personal information in the manner contemplated by the California Consumer Privacy Act or similar state privacy laws.

We may use Subscriber personal information for our own business purposes, such as for internal research, service improvement, and technological development. This is not considered "selling" of personal information under applicable law.

Your Rights

You have rights under certain US state data protection laws. These rights are not absolute, and in certain cases, we may decline your request as permitted by law. Your rights may include:

  • Right to know whether we are processing your personal data;

  • Right to access your personal data;

  • Right to correct inaccuracies in your personal data;

  • Right to request deletion of your personal data;

  • Right to obtain a copy of the personal data you previously shared with us;

  • Right to non-discrimination for exercising your rights;

  • Right to opt out of the processing of your personal data if it is used for targeted advertising, sale, or profiling that produces legal or similarly significant effects.

Depending on the state where you live, you may also have the following rights:

  • Right to access the categories of personal data being processed (as permitted by applicable law, including the privacy law in Minnesota);

  • Right to review, understand, question, and, depending on where you live, correct how personal data has been profiled (as permitted by applicable law, including the privacy laws in Connecticut and Minnesota);

  • Right to limit use and disclosure of sensitive personal data (as permitted by applicable law, including the privacy law in California);

  • Right to opt out of the collection of sensitive data and personal data collected through the operation of a voice or facial recognition feature (as permitted by applicable law, including the privacy law in Florida).

How to Exercise Your Rights

To exercise these rights, you can contact us by submitting a data subject access request, by emailing us at Support@AsphaltPavingMastery.com, by calling us at (407) 687-0267, or by referring to the contact details at the bottom of this document.

We will honor your opt-out preferences if you enact the Global Privacy Control (GPC) opt-out signal on your browser.

Under certain US state data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof of valid authorization to act on your behalf in accordance with applicable laws.

Request Verification

Upon receiving your request, we will need to verify your identity to determine that you are the same person about whom we have the information in our system. We will only use personal information provided in your request to verify your identity or authority to make the request. If we cannot verify your identity from information already maintained by us, we may request additional information for the purposes of verifying your identity and for security or fraud-prevention purposes.

If you submit a request through an authorized agent, we may need to collect additional information to verify your identity before processing your request. The agent will need to provide written and signed permission from you to submit the request on your behalf.

Appeals

Under certain US state data protection laws, if we decline to take action regarding your request, you may appeal our decision by emailing us at Support@AsphaltPavingMastery.com. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may submit a complaint to your state attorney general.

California "Shine The Light" Law

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing using the contact details below.

Asphalt Paving Mastery does not currently share personal information with third parties for those third parties' direct marketing purposes. If our practices change in the future, this section will be updated accordingly.


12. DO WE MAKE UPDATES TO THIS NOTICE?
